REFER A FRIEND PROGRAM TERMS AND CONDITIONS

1. General

These terms and conditions apply to EasyFlexibility.com and ElasticSteel.com’s Refer-A-Friend Program ("Program"). By referring a friend or family member who meets EasyFlexibility.com’s and ElasticSteel.com’s  registration requirements, or otherwise participating in the Program, you agree to be bound by EasyFlexibility.com’s and ElasticSteel.com’s  General Terms and Conditions listed here, and the EasyFlexibility.com’s and ElasticSteel.com’s Terms of Service (collectively, the "Program Terms and Conditions").

Referrer will refer a friend or family member by giving them access to 1 (one) of their favorite programs. Friend of family member will then get access to this 1 (one) online training program for the duration of 24 hours. Once the Referee purchases a program from EasyFlexibility.com or ElasticSteel.com and begins their training, the Referrer will get 50% store credit points from the amount that Referee will spend in our store.  For example if a Referee spends $100.00 in the store. The Referrer will receive a $50.00 store credit that they can use towards purchase of any programs of their choice.  If the Referee files for a credit card dispute, the Referrer will have to forfeit their store credit and/or any free program(s) that they have received.

2. Program Participation

The Program is only available to current EasyFlexibility.com and ElasticSteel.com members who refer a new friend or family who do not yet have an account created with EasyFlexibility.com or ElasticSteel.com.  EasyFlexibility.com or ElasticSteel.com reserves the right to modify, extend or cancel this Program at any time. The Program is only available online at EasyFlexibility.com. This program is only valid from October 3^rd to October 21^st, 2022. Internet access is required for participation in the Program. Current EasyFlexibility.com members who initiate a referral on EasyFlexibility.com are defined as "Referrers." Non-members who become an EasyFlexibility.com member upon accepting a referral are defined as "Referees."

3. Eligibility

You must have an existing EasyFlexibility.com or ElasticSteel.com account to be eligible for the Program, to make referrals, and to receive referral rewards. The Program is only available for EasyFlexibility.com or ElasticSteel.com members. Excludes EasyFlexibility.com or ElasticSteel.com employees. To make referrals, you must:

1. Share 1 (one) of your favorite programs with your friend or family member.
2. Once your friend makes a purchase tell us the name of your friend and what they bought
3. Use the reward points as described in Section 1 towards purchase of any programs of your choice.

Participation in the Program is prohibited where void by applicable law or regulation. The Program is only available through EasyFlexibility.com. You cannot earn a referral reward for referring someone who is already an EasyFlexibility.com or ElasticSteel.com member, or for referring yourself. Referral new account activation must be new to EasyFlexibility.com or ElasticSteel.com.

If the person you have referred is already an EasyFlexibility.com or ElasticSteel.com member, they will not be able to claim that they were referred by you, and neither of you will receive a reward for the referral. You can only accept one referral per person that you refer; you cannot accept multiple referrals from one person.

Referrer's existing account registration at EasyFlexibility.com or ElasticSteel.com and referral messages sent to a referee must be prior to the referee's opening of a new account.

There is no limit to how many eligible referrals an existing EasyFlexibility.com or ElasticSteel.com member can make during the duration of this promotion, that is from October 3^rd, to October 21^st 2022.

EasyFlexibility.com or ElasticSteel.com reserves the right to void any referral reward based on the following: (1) ineligibility of any Program participant, (2) fraudulent activity, or (3) if EasyFlexibility.com or ElasticSteel.com, in its sole discretion, finds that you have violated any of the Program Terms and Conditions.

4. Reward

As a referrer, you will be eligible to receive 50% store credit rewards from the amount that your referee will spend in our store during the duration of the promotion which will run from October 3^rd – October 21^st, 2022. As a referrer you will only be able to receive the 50% store credit from the amount that your referee will spend in our store during the promotional period. Meaning that if your referee purchases something from our store On October 22^nd you will not be eligible to receive these rewards, as the promotion would have ended. Referral rewards will be fulfilled by EasyFlexibility.com or ElasticSteel.com. They will be sent to the email account associated with your EasyFlexibility.com or ElasticSteel.com account. Allow up to 6 weeks for delivery after new-member activation and campaign sign up by the referee. Referral rewards are non-transferable, non-assignable, and cannot be redeemed or exchanged for cash, credit or other merchandise outside of the Program.

5. Tax

You are responsible for any and all tax liabilities associated with the Program.

6. Void Where Prohibited

This Program is void where prohibited by law.

7. Additional Terms and Conditions

We reserve the right to change the terms and conditions of the Program at any time, without notice, at our sole discretion. We reserve the right to not award a reward or disqualify someone from the Program if we feel, in our sole discretion, that fraudulent behavior or other unethical conduct has occurred in any way that compromises the fairness of the Program in any way. Rewards cannot be combined with other promotions and are not valid for previous offers or orders. Spam, unsolicited commercial email, or any form of illegal means of communication is illegal, prohibited, and will be grounds for termination of your participation in this Program. Fraudulent or unethical means of communication such as using bots, fictitious identities, fake emails, or scripts is also prohibited and will result in similar actions by us with respect to terminating your participation in the Program. EasyFlexibility.com products are subject to additional terms, conditions, and other restrictions.

By participating in this Program, you agree to release and hold harmless EasyFlexibility.com, as the operator of the Program, and its affiliates and subsidiaries, directors, officers, employees, consultants, and agents, and any other entity associated with marketing this Program (collectively, the "Released Parties") from any and all claims or damages arising out of, or in connection with the Program. You further agree that the Program and rewards are provided "as is where is". THERE ARE NO REPRESENTATIONS OR WARRANTIES INCLUDING BUT NOT LIMITED TO STATUTORY WARRANTIES AND CONDITIONS, WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, THIRD PARTIES RIGHTS, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. IN NO EVENT WILL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY CONSEQUENTIAL, INCIDENTAL, OR SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF ONE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.
